Marriages are often simple, but divorces are usually complicated. If you and your spouse are on good terms and plan to separate, you may still have to decide on certain aspects, such as distribution of assets, child support & custody, and so on. In case you are confused about choosing between mediation or collaborative divorce, it is best to know the pros and cons of both before taking the final call. The eventual objective is to avoid a contested divorce, which is time-consuming and expensive.

The basics of mediation

In case of mediation, a mediator works with the couple and helps them reach a general agreement that’s acceptable to both. The mediator is always neutral, and if you and your partner are not fighting it out, mediation might solve things amicably. Does this mean that you don’t need an attorney? While mediation is meant to beneficial for both parties, it is best to have legal counsel on your side, so that you are assured of your part in the agreement. Your lawyer will negotiate, talk and add points, where needed, so that mediation doesn’t seem unbalanced and is acceptable in court.

The basics of collaborative divorce

True to the name, collaborative divorce involves a settle, where attorneys of both parties come together and decide on an agreement for various points of concern. In a way, you are still trying to agree with your spouse and this is considered to be a collaborative process. Since more people and legal experts are involved, collaborative divorce can be expensive. However, there are a few benefits that are hard to ignore. For instance, having an attorney on your behalf will ensure that you don’t make expensive mistakes.

What’s better?

Well, it depends. If you think you are well-versed with the basics of law and can represent yourself aptly, mediation is a cheaper alternative and can work for your case. However, if you are hesitant in speaking up or don’t have a firm voice, you may consider relying on someone working as your advocate. Mediators don’t work as an advocate for either side. Which can be a disadvantage for some people. If you want to get the best possible outcome from the divorce and wish things to be handled more professional, opting for collaborative divorce and hiring a divorce attorney are great steps to consider.
